Terms and Conditions

1. Service Providers

2. Acceptance

By creating an account or using the App, you accept these Terms. If you do not accept them, you must not use the service.

3. Service Description

SPACE is a mobile platform that lets you: create shared folders (including private folders with end-to-end encryption of photo content); invite users with collaboration roles; upload and organise photos; interact via comments, favourites and friendships; share invite links (7-day, multi-use) and receive in-app notifications. Favourite photos (reposts) are visible to accepted friends in the user profile.

4. Account

  • Provide accurate information and keep your credentials secure.
  • Do not share your account with third parties.
  • You are responsible for all activity on your account.
  • Report unauthorised access immediately.

5. Age Requirements

Use of the App is permitted to users who are at least 14 years old (in Italy, pursuant to Art. 2-quinquies of Legislative Decree 196/2003), or the higher minimum age required by the law applicable in their country. Below the applicable threshold, use is permitted only with the explicit consent of a parent or guardian.

6. Acceptable Use

Prohibited: posting illegal, defamatory or violent content; uploading protected material without authorisation; violating others' privacy; compromising App security; using bots or unauthorised automation; sending spam; impersonating others; abusive behaviour. SPACE has a zero-tolerance policy for objectionable content and abusive behaviour.

7. User Content

You retain ownership of your content. By uploading, you grant the controllers a limited licence to host, process and make it available per your settings.

On account deletion:

  • Photos and comments in folders shared with others remain visible with an anonymised author, to preserve the integrity of shared content.
  • Content in folders where you were the sole member is permanently deleted.
  • Folders you owned with other collaborators are transferred to the most senior collaborator or admin.

8. Shared Folders, Invitations and Roles

The folder owner or authorised members manage participants and permissions. Invite links are multi-use and valid for 7 days; you are responsible for how they are shared. Private folders apply end-to-end encryption to photo content; the controllers cannot access photos in plaintext. Metadata (names, roles, timestamps) are not end-to-end encrypted. Only explicitly uploaded Space cover photos are not E2E-encrypted; when no explicit cover is set, home screen card previews display actual encrypted photos from the folder, which remain E2E-protected. Resetting your password generates a new E2E keypair — the old private key is irreversibly discarded and all existing private folders become permanently inaccessible; the folder owner or an admin must re-invite you to re-wrap the encryption key for your new public key.

9. Moderation

The controllers may remove illegal content, suspend accounts and cooperate with authorities. To report: report@spaceeapp.com. The controllers aim to review reports within 24 hours. Built-in tools are available to block abusive users.

You may appeal any moderation decision by writing to legal@spaceeapp.com, stating the content concerned and the reasons for your appeal. The controllers will provide a reasoned response within a reasonable timeframe.

10. Intellectual Property

The App (software, interfaces, design, trademarks) is protected by intellectual property law. Without written authorisation, you may not copy, modify or commercially exploit it.

11. Third-Party Services

The App uses Supabase Inc. (infrastructure) and Expo Inc. (distribution, push notifications), along with other technical providers subject to their own terms. The controllers are not liable for failures solely attributable to third-party providers beyond their reasonable control.

12. Service Availability

The service is provided 'as is'. The controllers aim to keep it reasonably available but do not guarantee continuity or error-free operation.

13. Suspension and Account Deletion

You can delete your account at any time from App settings. The controllers may suspend or close accounts for Terms violations, unlawful use or regulatory requirements.

14. Limitation of Liability

To the extent permitted by law, the controllers are not liable for indirect damages, data loss or service interruptions, nor for user content or user interactions. Liability for fraud, gross negligence and non-excludable matters remains unaffected.

15. Indemnification

You agree to indemnify the controllers against third-party claims arising from your uploaded content, Terms violations or unlawful use of the App.

16. Changes to Terms

The controllers may update these Terms. For material changes, at least 7 days' notice will be given via in-app notifications or email. Continued use constitutes acceptance. Technical corrections take effect immediately.

17. Applicable Law

These Terms are governed by Italian law. Consumer disputes are heard in the consumer's place of residence. Other disputes are subject to the exclusive jurisdiction of the Milan courts.

18. Final Provisions

If any clause is invalid, the remainder is unaffected. In case of translation, the Italian version prevails.
